<h1>Biohost Terms of Service</h1>

Biohost takes on the responsibility to protect and ensure each client receives the best service possible. These guidelines have been written to prevent the actions of one client negatively affecting other clients.

<h2>Questions and Concerns</h2>

All questions and concerns regarding our service should be asked prior to purchasing any service from Biohost.

<h2>Content</h2>

You the user and customer agree to never use our services to upload and distribute and or link to any of the following content.

<ul>
	<li>Child pornography</li>
	<li>Terrorism and anything related to</li>
	<li>Racism and Hate crime related</li>
	<li>Phishing and or anything to compromise another person(s) identity</li>
	<li>Any type of script and or file that tries to interfere with another's website, server and or home connection (DDoS attacks)</li>
</ul>

If any of the above content is found or related to your services with us your account will be terminated immediately without any notice and no refund will be issued.

<h2>Server Abuse</h2>

Any type of attempt or scheme to cause harm to any of our servers, company and or clients is strictly prohibited. Any customer found to be doing this will have there account terminated without notice and will be banned from all of our servers and will be reported to there internet service provided about there actions.

<h2>Usage Policy</h2>

While using any service provided by Biohost you agree to follow our usage policy. 

You agree to not use our shared hosting services or seedboxes for any of the following:

<ul>
	<li>IRC and anytype of chat room</li>
	<li>Any type of bot</li>
	<li>Any type of daemon</li>
	<li>Any type of monitor</li>
	<li>Any type of spam email / Bulk email</li>
	<li>Any type of resource heavy script</li>
	<li>To send mass amounts of visits and or ddos a website, server and or persons.</li>
</ul>

You agree to not to use our seedbox services for any of the following:

<ul>
	<li>Sharing your account with other friends</li>
	<li>Personal file storage via FTP</li>
	<li>Download torrents that are in violation with our content restrictions</li>
	<li>Distributing fake torrents</li>
	<li>Any malware distribution</li>
</ul>

Any usage in these will result in your account being suspended and a warning sent to you. Once you reply we will un suspend your account and if it continues we will terminate your account without notice.

<h2>Resource Usage</h2>

Users are allowed to use a maximum of %25 of the servers resources for no more then sixty seconds at a time. If your website or usage requires more resource usage then we offer we may require you purchase a larger hosting plan or a custom resource increase. If this is not enough we may suggest you move to a virtual private server or a dedicated server or possibly take your account elseware where they can accommodate your resource usage. If your account is deemed to be resource heavy we may suspend it and send you a email regarding it and asking you to reduce usage. Once you reply we will un suspend your account. If you deny our suggestions or upgrade and continue to over use resources we will suspend access to your website and give you seven days to back up your files and move to another hosting provider. Once the seven days are over your account will be terminated and all your files will be removed from the server.

<h2>User Privacy / Policy</h2>

All information submitted to Biohost will not be released to any third party company and will soley be kept in our databases.
The only circumstances in which your information is revealed to a third party is if you break and violate our terms of service and if/or there is a lawfully submitted request for it.

<h2>Back ups and lost data</h2>

Biohost does not guarantee to keep back ups of any of your data and or files (Unless purchased as a add-on to your hosting account, then it is guaranteed to be backed up nightly) You the user are responsible for keeping a up to date back up of all your files and or databases stored on our server(s). In the event of data loss (Hard drive failure/other problems etc etc) Biohost will in no way provide compensation for lost files and data what so ever. We do our best to make sure our hard ware is working properly and is up to date with current technology. Once again, Biohost is not responsible in any way or form for loss of data and or files.

<h2>Account setup</h2>

<h3>Hosting</h3>

Hosting accounts are set up automatically once the first payment is received. You will receive a email with your account details shortly after the payment is complete. If you do not receive these account details please open a support ticket with us and the issue will be resolved. If you pay with a paypal e-check your account will be set up once the check clears which may take up to five business days.

<h3>Seedboxes</h3>

The average time for a seedbox to be set up is around six hours but in some cases can take up to forty-eight hours depending on availability. If for any reason Biohost cannot provide you with a seedbox in the forty-eight hour time frame we will offer you two options.<br /><br />

1. A full refund of your money<br /><br />
2. Give you a estimated time frame in which we could set up your account. Your billing will not start until your account is set up.

<h2>Account Suspension and Termination</h2>

Biohost reserves the right to suspend or terminate your services with no warning prior however this is only done in extreme circumstances. If your account is ever suspended or terminated we will send you a email within twenty-four hours explaining why and how (if your account was suspended) you can get it un suspended.

<h2>Refunds</h2>

All payments made to Biohost are non-refundable, however in the situation in which we cannot provide you a service in which you paid for you will be refunded in full. In the case of account termination because of Biohosts fault in which we may not be able to host your site you will be given a prorated refund (Subtracted on how many days of un used service you have remaining). If you break our terms of service in ANY way you will not be refunded what so ever. All paypal disputes raised with Biohost will be referred to this terms of service you agreed to and your services with us will be terminated.<br /><br />

If you fail to comply to these terms of services your account will be suspended and or terminated without warning.<br /><br />

All emails referenced in this terms of service will be delivered to the email address you provide to us when signing up for service. Biohost reserves the right to modify these terms at any time.
